The sales contract is concluded in Polish, for time and purpose of sale.

Unless the contract provides otherwise, the Seller shall release the goods to the Buyer immediately after the conclusion of sales contract.

TERMS & CONDITIONS FOR COMPLAINTS PROCEDURE

The Seller is obliged to deliver the goods without defects – unless the Seller informed the Consumer about the defects of the goods before concluding sales contract.

In the event of a defect in goods, the buyer may file a complaint regarding defective goods based on the warranty regulated by the Civil Code.

Exercising the warranty, the Buyer may, following the terms and the deadlines specified in the Civil Code:

  1. Submit a price reduction statement
  2. In case of a significant defect – submit a statement of withdrawal from the contract
  3. Request replacement of goods to be free of defects
  4. Request removal of the defect

The Seller asks for filing complaints based on warranty by electronic means, in writing or in person at the Store.

For the purposes of processing the complaint filed on the basis of a warranty, the Consumer, if necessary, is obliged to deliver the defective goods to the address of the Store on the expense of the Seller.

The Seller recommends that the following information be included in the complaint notification: identification data of the Buyer, a brief description of the defect, the circumstances of finding the defect and Buyer’s claim for complaint.

Every recommendation of the Seller, which is in this document, has only the nature of a non-binding indication for the Consumer, from which the Consumer may or may not take advantage. Consumer’s failure to follow Seller’s instructions does not affect the rights of the Consumer, in particular does not affect the rights associated with the warranty.

The Seller will respond to the complaint within 14 days.

EXTRAJUDICIAL METHODS OF EXAMINING COMPLAINTS AND INVESTIGATING CLAIMS

In a situation when the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:

  • Contract for the provision of services or activities undertaken at your request, aimed at its conclusion (Article 6 (1) (b) of the GDPR)

no possibility to make purchase in the Store

Data processing until you withdraw your consent remains legal.

PROCESSING PERIOD

The Seller will process your data only for the period in which he will have a legal basis, and thus until the moment in which:

  • the legal requirement obliging him to process your data ceases to apply
  • the possibility of determining, investigating or defending any claims related to the agreement concluded by the Store by the parties will cease
  • you will withdraw consent to the processing of data if this was its basis
  • your objection to the processing of your personal data will be accepted – if the basis for the processing of your data was the legitimate interest of the administrator or if the data was processed for the purpose of direct marketing

You have the right to request:

  • access to your personal data,
  • correcting it,
  • deleting it,
  • limitation of processing,
  • transfer data to another administrator,

And:

  • object to the processing of your data at any time:
  • for reasons related to your particular situation – to the processing of personal data concerning you, based on art. 6 par. 1 lit. f of the GDPR (i.e. on legally justified interests carried out by the administrator)
  • if personal data is processed for direct marketing purposes, to the extent that the processing is related to such direct marketing.
